Terms and Conditions of Residence

The Agreement of Terms and Conditions is between Brockley Court and The Resident.

 

  1. Upon payment of the monthly charge as hereinafter defined in paragraph 2, Brockley Court Home undertake to provide accommodation, food, light, heat, laundry and all the necessary personal care which would normally be required by a resident of a care home. 
  2. The Resident will be accommodated in a mutually agreed room. In the event that the resident has to be transferred to another room, for any reason, this will only be undertaken after full consultation and agreement of the Resident and/or their representative. 
  3. The monthly charge shall be a mutually agreed initial sum per week paid monthly in advance or arrears by cash, cheque, bankers or standing order.

    The charge is calculated as follows:

a)      Accommodation to include food, light, heat and laundry services.

b)     Personal Care (this is a standard Brockley Court charge).    £290.

 

4.      It is agreed that the charge coving the provision of all services referred to in clause 1 above is subject to review, from time to time, as determined by Brockley Court. Any increase in the fee will be as a result of inflation, any other increase in overheads or operating costs, which Brockley Court experiences for the provision of care and service or as a result of statutory provisions coming into force after the date hereof.

     The resident will be notified in writing of any increment in the                

     Charge stated in clause 3 with reasons for the increment clearly

     Outlined four weeks prior to the increment being charged. 

  1. The Resident shall be charged from his/her own resources (other than medication by prescription) for: 

a)      Hairdressing.

b)     Opticians (if applicable)

c)      Dentists (if applicable)

d)     Newspapers/magazine subscriptions

e)      Personal clothing

f)       Toilet requisites and other items of luxury or personal nature

g)      Telephone calls charged at current domestic rate

h)      Transport provided by the home for private appointments based on taxi rates

i)        Outings, social and leisure activities

 

Any other services that cannot be categorised under the services listed in clause 1 and 3.

 

  1. Brockley Court undertakes to maintain a standard of care as required by the Commission for Social Care Inspection. If an occasion should occur where a complaint or query arises The Resident is required to follow the Brockley Court written procedure for dealing with complaints. 
  2. This agreement shall continue in force until terminated by either party giving to the other written notice of 4 weeks before termination. Should the Resident leave the home without giving the required notice, payment of fees in lieu of notice at normal weekly rate will be required. 
  3. The first month of admission shall be regarded as a trail period for the benefit of the Resident and Brockley Court. 
  4. Brockley Court will be the abode of the Resident. Should the Resident at any time require hospital treatment or otherwise be absent from the Home, Brockley Court will retain the accommodation for the full and current weekly fee, unless the 4 week notice for termination of contract is given by either party to the other. 
  5. In the event of death of the Resident, any fees outstanding will be charged to their estate. Third parties who agree to meet the Resident’s fees in whole or part must sign below to this effect before the said person becomes a Resident. 
  6. Brockley Court may give notice to the Resident of termination of this agreement as outlined in clause 4 above, requiring the Resident to leave the Home under the following circumstances.

            a)      Non-payment of fees.

b)     If having consulted the Resident and taken advice from the appropriate member of the primary health care team, e.g. GP, Consultant Specialist or Social Worker, concerning the present and future care needs of the Resident; Brockley Court is no longer able to meet The Resident’s needs.

c)      If, after a hospital treatment, the condition of the resident changes drastically and the home is unable to meet The Resident’s needs following a full clinical assessment and consultation with all professionals concerned.

d)     Any circumstances or behaviour which Brockley Court Home feel may be seriously detrimental to the Home or welfare of other Residents and / or staff.

 

  1. Residents will be required, before taking up residence, to provide information to Brockley Court Home on the state of their health, any treatment required and the name of the medical advisor and complete all necessary consent forms in respect therefore including Access to Medical Record Act Forms.
  2.  The Resident or, where appropriate, his or her representative may request Brockley Court Home to take charge of and dispense all the Resident’s prescribed medications. If a resident should be able to take charge of his/her medication then a suitable locked cupboard will be provided. The Home cannot accept responsibility for the misuse of medications that are kept by the Resident. 
  3.  The Residents are free to journey out alone, however, Brockley Court Home cannot accept responsibility for a Resident’s safety away from the Home unless the journey and any necessary supervision were arranged by the Home. 
  4. All electrical items brought by the Resident on admission or during occupation of the Home shall be first inspected as to their safety by Brockley Court Home before use.
  5. At the discretion of Brockley Court Home items of furniture may be brought in by the Resident subject to inspection as to condition and defects liable to render the article unsafe or unfit. Transportation insurance and eventual removal of such items shall be the Resident’s responsibility or that of the executors. 
  6. Brockley Court Home is insured for valuable effects left in the Resident’s rooms. All items need to be itemised, but insurance does not extend to the Resident’s cash securities and other monies. All valuable assets must be declared upon admission for insurance purposes. Safekeeping can be arranged at Brockley Court Home.
